PUBLIC OFFER
on the conclusion of a retail purchase and sale agreement for public catering products via the WOK & STREET 77 websites and mobile applications

This document is a public offer of SMART DORADO LLC, TIN 303 450 997, address: Republic of Uzbekistan, Tashkent, Mirzo-Ulugbek district, Uzbekiston Ovozi street, 21, and defines the terms for placing, paying for, preparing, receiving and delivering orders for public catering products via the official websites and mobile applications of WOK & STREET 77.
By placing an Order via the Service, the User confirms that they have read this Offer, understand its content and accept its terms in full.
1. TERMS AND DEFINITIONS
1.1. Company (Operator of the Service) — SMART DORADO LLC, TIN 303 450 997, address: Republic of Uzbekistan, Tashkent, Mirzo-Ulugbek district, Uzbekiston Ovozi street, 21, which manages the WOK & STREET 77 Service.
1.2. Seller — the Company and/or the relevant legal entity that prepares and sells the Products under a specific Order of the User.
Information on the Seller of a specific Order is indicated in the fiscal receipt and/or other Order information provided to the User.
1.3. WOK & STREET 77 (the Service) — the aggregate of the official websites wok.uz, street77.uz, the WOK and STREET 77 mobile applications and the related electronic services through which the User may review the assortment, compose, place and pay for an Order, select the method of receiving it and use other available functions.
The existence of separate websites or mobile applications for the WOK and STREET 77 brands does not prevent the application of this Offer, provided that a link to it is placed in the relevant Service.
1.4. User (Buyer) — an individual using the Service and/or placing an Order for personal, family, household and other purposes not related to business activity.
1.5. Products — dishes, beverages, culinary products and other goods offered for ordering through the Service.
1.6. Order — a request composed by the User via the Service for the preparation and handover of the Products selected by them on the terms of this Offer.
1.7. Delivery — handover of the Order to the address specified by the User by means of an engaged partner delivery service.
1.8. Self-pickup — receipt of the Order by the User directly at the selected WOK and/or STREET 77 restaurant.
1.9. Personal Account (Account) — the User’s account in the Service, created using a mobile phone number and other data provided for by the functionality of the Service.
1.10. Support Service — the Company’s service that receives and considers Users’ enquiries on the use of the Service and the fulfilment of Orders.
1.11. Acceptance — full and unconditional acceptance by the User of the terms of this Offer by performing the actions provided for in Section 3 of this Offer.
2. GENERAL PROVISIONS AND SUBJECT OF THE OFFER
2.1. This Offer governs the relations arising when the User places Orders directly via the WOK & STREET 77 Service.
2.2. The Seller undertakes to prepare and hand over to the User the Products selected by them in accordance with the confirmed Order, and the User undertakes to accept and pay for the Order in accordance with the terms of this Offer.
2.3. Information on the available Products, their price, main characteristics, portion size or weight and other material parameters is displayed to the User in the Service.
2.4. The Company may change the assortment, prices, menu composition, promotion terms and availability of individual items prior to the placement of the relevant Order.
After confirmation of an Order, its cost may not be changed unilaterally, except where the composition of the Order is changed at the User’s initiative or with their consent.
2.5. This Offer does not fully govern the relations arising where the User places an Order directly through the interface of a third-party food delivery aggregator or other independent electronic platform.
In such cases, the placement of the Order and the User’s interaction with the relevant platform are additionally governed by the terms of that platform.
2.6. If an Order is placed directly via the WOK & STREET 77 Service and a third-party partner delivery service is engaged for its delivery, this Offer applies to such Order.
3. PROCEDURE FOR CONCLUDING THE AGREEMENT AND ACCEPTANCE OF THE OFFER
3.1. Before the placement of an Order is completed, the User is given the opportunity to read this Offer via a link in the Service.
3.2. The User independently composes the Order by selecting:
3.3. Acceptance of this Offer in respect of a specific Order is the User’s pressing of the “Place order”, “Order”, “Confirm order”, “Pay” button or another button of similar meaning after the Order has been composed and its final cost displayed.
3.4. From the moment of Acceptance, an agreement in respect of the specific Order is deemed concluded between the User and the relevant Seller.
3.5. Registration or Authorisation of the User in the Service does not in itself constitute the placement of an Order and does not create an obligation to purchase or pay for any Products.
3.6. Before Acceptance, the User may freely change or remove items of the Order, change their quantity, the delivery address, the method of receipt and other available parameters.
3.7. The User may cancel an Order through the functionality provided in the Service or by contacting the Support Service, if fulfilment of the Order has not yet begun.
3.8. If preparation of the Order has already begun or the Order has been handed over for delivery, the possibility of its cancellation is determined taking into account the stage of fulfilment of the Order, the costs actually incurred and the requirements of the legislation of the Republic of Uzbekistan.
This clause does not limit the rights of the User granted by consumer protection legislation.
4. PLACEMENT AND CONFIRMATION OF AN ORDER
4.1. The User is obliged to provide accurate information necessary for the fulfilment of the Order.
4.2. When placing an Order with Delivery, the User specifies the address and contact details enabling the Order to be handed over.
4.3. The User is responsible for the correctness of the data entered by them.
4.4. After an Order has been placed, the Service provides the User with information on acceptance of the Order via the Service interface, a push notification, SMS, email or any other available means.
4.5. Acceptance of the Order means the start of its processing by the relevant restaurant.
4.6. If a particular item cannot be prepared, the Seller may contact the User and offer to:
4.7. A missing item is replaced with another only with the User’s consent.
If the User does not agree to the replacement, the cost of the missing item, if it has been paid for, is subject to refund.
5. PRODUCTS AND INFORMATION ABOUT THEM
5.1. The assortment of Products is determined based on the menu and availability of the specific restaurant at the time the Order is placed.
5.2. The Service provides the User with information on the Products necessary for their informed choice.
5.3. The appearance of the Products actually prepared may differ slightly from the photographs and other images in the Service due to the specifics of manual preparation, the arrangement of ingredients, technological features, lighting during photography and other natural factors.
Such differences must not result in a material discrepancy between the Products and their stated appearance, composition and main consumer characteristics.
5.4. The weight and volume of the Products are determined in accordance with the applicable recipe and technological documentation, taking into account permissible technological deviations.
5.5. The Products are manufactured in accordance with the applicable requirements of the legislation of the Republic of Uzbekistan, sanitary norms, safety requirements and the Seller’s internal technological standards.
6. ALLERGENS AND SPECIFICS OF PRODUCT COMPOSITION
6.1. A User who has a food allergy, individual intolerance to certain ingredients or other dietary restrictions is obliged to take such information into account when selecting the Products.
6.2. If there are any questions regarding the composition, the User may contact the Support Service before placing an Order.
6.3. Different types of Products using different ingredients may be prepared simultaneously in WOK & STREET 77 restaurants.
For this reason, it is impossible to completely exclude accidental contact between individual food ingredients and allergens during the storage, preparation or packaging of the Products.
6.4. If the absence of a specific allergen is critical for the User, it is recommended that they obtain additional information from the Company before placing an Order.
7. PRICES AND PAYMENT PROCEDURE
7.1. The cost of the Products is indicated in the soums of the Republic of Uzbekistan.
7.2. The final cost of the Order is displayed to the User before its confirmation.
7.3. If Delivery is chargeable, the cost of Delivery or the procedure for determining it is displayed to the User before confirmation of the Order.
7.4. The Order is paid for by one of the methods available in the Service at the time of its placement.
7.5. In the case of cashless payment, the payment may be processed by banks, payment organisations and other authorised services.
7.6. If the User’s bank details are entered directly in the interface of a bank or payment service, the Company does not receive or store the full details of the User’s bank card.
7.7. The User is provided with a fiscal cash and/or electronic receipt in the manner provided for by the legislation of the Republic of Uzbekistan.
8. DELIVERY
8.1. To deliver Orders, the Company and/or the Seller may engage third-party partner delivery services.
8.2. The specific delivery partner may be determined by the Company automatically based on:
8.3. The Company is not obliged to provide the User with the ability to independently select a specific partner delivery service, unless such a function is provided for by the Service.
8.4. For the purposes of Delivery, only the data necessary to carry out the specific delivery may be transferred to the partner service, including:
8.5. Such information is transferred in accordance with the legislation of the Republic of Uzbekistan and the WOK & STREET 77 Privacy Policy.
8.6. Delivery is carried out within the available delivery zone determined by the Service.
8.7. The estimated preparation and/or delivery time is displayed to the User in the Service or communicated to them by any other available means.
8.8. The actual delivery time may change due to:
8.9. The Company and the Seller take reasonable measures to fulfil the Order within the stated time and to inform the User of any material delay, where such information is available.
8.10. The User is obliged to ensure that they can be contacted at the phone number specified when placing the Order.
8.11. The User is obliged to ensure that the Order can be handed over at the address specified by them.
8.12. If the courier has arrived at the address specified by the User but handover of the Order is impossible for reasons attributable to the User, the courier and/or the Support Service may contact the User to agree on further actions.
9. SELF-PICKUP
9.1. Where technically possible, the User may select Self-pickup from an available WOK or STREET 77 restaurant.
9.2. The User independently selects the restaurant for receiving the Order from the list available in the Service.
9.3. Information on the readiness of the Order or the estimated time of its readiness is provided via the Service or by any other available means.
9.4. The User is advised to collect the Order as close as possible to the stated readiness time, since the organoleptic and other consumer properties of freshly prepared products may naturally change over time.
10. CHANGE AND CANCELLATION OF AN ORDER
10.1. Before preparation begins, the User may contact the Support Service or use the available functionality of the Service to change or cancel the Order.
10.2. After preparation has begun, the possibility of changing the Order depends on the stage of its fulfilment and the technical capability of the relevant restaurant.
10.3. If an Order cannot be fulfilled in whole or in part for reasons attributable to the Seller, the User is offered to:
10.4. The cost of a confirmed Order may be changed only in connection with an agreed change to its composition or in other cases provided for by law.
11. ACCEPTANCE OF AN ORDER
11.1. Upon receipt of the Order, the User is advised to check:
11.2. If a missing or incorrectly included item is discovered, the User is advised to contact the Support Service immediately.
11.3. Handover of the Order to the User or to a person accepting the Order at the address specified by the User is deemed fulfilment of the obligation to hand over the Order, unless otherwise follows from the nature of the breach or from legal requirements.
12. QUALITY, CLAIMS AND REFUNDS
12.1. The User may submit a claim in the event of:

12.3. The Company may ask the User to provide a photograph of the Products, packaging or other subject of the claim, if the photograph is objectively necessary to establish the circumstances of the enquiry.
The absence of a photograph does not in itself deprive the User of the rights provided for by law.
12.4. Depending on the nature of a confirmed claim, the User may be offered to:
12.5. If the Products do not correspond to the ordered type, composition, quantity or description, the User’s rights are determined by the legislation of the Republic of Uzbekistan.
12.6. Refunds are made, as a rule, by the same method by which payment was made, unless another method is provided for by law or agreed by the parties.
12.7. After a decision on a refund has been taken, the Company and/or the Seller initiate the refund without undue delay in the manner and within the time limits provided for by law and by the rules of the relevant payment service.
12.8. The time it actually takes for the refunded funds to appear in the User’s bank account or card after the refund has been made may depend on the bank or payment organisation.
12.9. No provision of this Offer may be interpreted as limiting the consumer rights granted by the legislation of the Republic of Uzbekistan.
13. PROMOTIONS, DISCOUNTS AND PROMO CODES
13.1. The Company may run promotions and provide discounts, promo codes, special prices, special sets and other offers.
13.2. The terms of a specific promotion are communicated to Users via the Service, advertising materials or a separate description of the relevant promotion.
13.3. A promotion may be subject to restrictions as to:
13.4. Unless expressly stated otherwise, discounts, promo codes and other special offers may not be combined with one another.
13.5. The Company may terminate a promotion or change its terms in respect of future Orders.
Such changes do not apply to Orders confirmed before the changes entered into force.
13.6. The Company may restrict the use of a promo code or special offer if a technical error, repeated bad-faith use, fraudulent actions or other abuse is detected.
14. REGISTRATION AND PERSONAL ACCOUNT
14.1. To use certain functions of the Service, the User may be required to complete Registration and/or Authorisation.
14.2. Registration and Authorisation may be carried out by means of a mobile phone number, a one-time SMS code or another method provided for by the Service.
14.3. The User is obliged to provide accurate contact details.
14.4. The User is responsible for maintaining access to their mobile device and Authorisation means.
14.5. The User may not knowingly provide third parties with one-time codes and other confidential data intended for Authorisation.
14.6. If unauthorised use of the Account is suspected, the User must contact the Support Service.
14.7. The User may delete their Account through the functionality provided by the Service or by contacting the Support Service, unless a different procedure is provided for by law.
15. PERSONAL DATA
15.1. The Company processes Users’ personal data in accordance with the legislation of the Republic of Uzbekistan and the separate WOK & STREET 77 Privacy and Personal Data Processing Policy.
15.2. Depending on the functions used by the User, the Service may process, among other things:
15.3. Access to geographic location is obtained only where the relevant permission has been granted by the User through the operating system of their device or by another means provided for.
15.4. Geolocation may be used to:
15.5. The User may prohibit the Service from accessing geolocation through the settings of their device.
In this case, automatic location detection functions may be unavailable.
15.6. For the fulfilment of an Order, the necessary information may be transferred to the Seller, the partner delivery service, the payment organisation and other parties solely to the extent and on the terms provided for by law and the Privacy Policy.
15.7. Detailed information on the purposes, grounds, periods and methods of processing, storage and protection of personal data is set out in the WOK & STREET 77 Privacy Policy.
16. NOTIFICATIONS
16.1. The Company may send the User service messages directly related to:
16.2. Service messages are not advertising messages.
16.3. Advertising and marketing messages are sent to the User in the manner established by law and the Privacy Policy.
17. RIGHTS AND OBLIGATIONS OF THE USER
17.1. The User undertakes to comply with the terms of this Offer and the legislation of the Republic of Uzbekistan.
17.2. The User is obliged to provide accurate information necessary for the fulfilment of the Order.

18. RESTRICTION AND BLOCKING OF THE ACCOUNT
18.1. The Company may temporarily restrict the use of certain Account functions where there are reasonable indications of:
18.2. Where necessary, the Company may request additional information from the User to verify the circumstances.
18.3. The User may contact the Support Service to clarify the reasons for the restriction.
18.4. Blocking or restriction of the Account does not terminate the obligations of the parties under previously concluded and unfulfilled agreements.
18.5. Blocking of the Account does not deprive the User of lawful claims related to previously placed Orders.
19. INTELLECTUAL PROPERTY
19.1. The trademarks, logos and brand designations of WOK and STREET 77, the design of the Service, texts, photographs, software elements and other intellectual property objects belong to the respective rightholders and are protected by law.
19.2. Use of the Service does not grant the User the right to use such objects for commercial purposes or in any other way going beyond ordinary use of the Service.
20. LIABILITY
20.1. The Company, the Seller and the User bear liability in accordance with this Offer and the legislation of the Republic of Uzbekistan.
20.2. The Company is not liable for the impossibility of using certain functions of the Service caused by:
20.3. The Company is not liable for incorrect fulfilment of an Order to the extent that it is directly caused by the User providing an incorrect address, phone number or other material information.
20.4. The engagement of a partner delivery service does not in itself release the parties from the performance of obligations imposed on them by law and by this Offer.
20.5. The provisions of this Section do not apply to the extent that they would limit the mandatory liability of the Seller or the consumer rights established by the legislation of the Republic of Uzbekistan.
21. FORCE MAJEURE
21.1. The parties are released from liability for full or partial non-performance of obligations if it results from force majeure circumstances which the party could not reasonably have foreseen or prevented.
21.2. Such circumstances may include natural disasters, fires, accidents, material interruptions in electricity or communications, decisions of state authorities, mass traffic restrictions and other force majeure circumstances.
21.3. The existence of force majeure circumstances does not release the parties from the performance of obligations which can objectively be performed after such circumstances cease, including refund obligations in the cases provided for by law.
22. AMENDMENTS TO THE PUBLIC OFFER
22.1. The Company may amend this Offer by publishing a new version in the Service.
22.2. A new version enters into force on the date of its posting or on another date expressly specified therein.
22.3. The version of the Offer in force at the time of Acceptance of a specific Order applies to that Order.
22.4. An amendment to the Offer does not change the terms of an Order already placed without the User’s consent, unless otherwise expressly provided by law.
23. TERM OF VALIDITY
23.1. This Offer is valid from the date of its publication until it is withdrawn or replaced by a new version.
23.2. Termination of the Offer does not terminate the obligations of the parties in respect of Orders placed during its validity period.
24. DISPUTE RESOLUTION AND USER ENQUIRIES
24.1. The Company is interested in the prompt settlement of Users’ enquiries.
24.2. On matters of fulfilment of an Order, the User may contact the Support Service.
24.3. When making an enquiry, it is recommended to state the Order number, a contact phone number and the circumstances of the enquiry.
24.4. The parties seek to settle a dispute through negotiations and consideration of the User’s enquiry.
24.5. If a dispute cannot be settled by the parties, it is resolved in the manner established by the legislation of the Republic of Uzbekistan.
24.6. This Offer does not limit the User’s right to apply to the authorised state bodies or a court in the cases and in the manner provided for by law.
25. APPLICABLE LAW
25.1. The legislation of the Republic of Uzbekistan applies to the relations between the User, the Company and the Seller.
25.2. In the part not expressly governed by this Offer, the parties are guided by the legislation of the Republic of Uzbekistan.
25.3. If any provision of this Offer is found to be invalid or unenforceable, this does not entail the invalidity of the remaining provisions of the Offer.

On matters of placing and fulfilling Orders, the quality of the Products, delivery, payment, refunds and use of the Service, the User may contact the Support Service:
